LIFO and Card Check

In an effort to serve our members’ best interest, the NASPD has taken a position against the repeal of LIFO (last in first out) as an available accounting procedure and against “card check” (giving unions an unfair advantage over business owners). These are issues that directly and significantly affect many of our members. If you are not familiar with these issues, we encourage you to see the links below to understand the impact they may have on your business. If you would like your voice heard on these issues, below are sample letters and links to your federal representatives. Dear Senator/Representative (NAME):

On behalf of my company, (NAME) and its xxx employees in your state/district, I am writing to express my strong opposition to the recently introduced Employee Free Choice Act H.R. 1049/S. 560. The reason is simple. This legislation would do away with a fair, proven, court-approved way to certify unions to represent employees in a workplace and substitute a union certification method that is obviously prone to coercion, bullying and similar tactics. At the heart of the matter is secret balloting, which current law requires because it provides the privacy and freedom from management or union coercion that every American worker deserves. The proposed substitute for this time-honored system is “card check,” which is completed in public view, leaving workers vulnerable to threats and intimidation from union leaders, management, or both.

I support the fair way that the National Labor Relations Board administers union certification elections today because it permits every employee to vote their conscience and support their personal and family interest as they see fit. No manager and no union organizer can pierce the sanctity of the NLRB ballot box. That’s as it should be.

I strongly urge you to resist those who would pressure you to vote for this major step backwards in U.S. labor law. I ask you to oppose the Employee Free Choice Act at every opportunity.

On behalf of my company, (NAME) and its xxx employees in your state/district, I am writing to express my strong opposition to the recently proposed repeal of LIFO. In an inflationary environment, LIFO enables a business to match up its current inventory costs with its current income, producing a more accurate picture of its annual income. LIFO reserves are an accounting entry. They do not reflect real assets and they can and do reflect illusory gains caused by economic inflation. Taxing businesses on the size of their LIFO reserves is both burdensome and unfair.

I strongly urge you to resist those who would pressure you to vote for this law because it will hurt the small businesses that are the backbone of our country.
