Two quick start-of-the-year reminders that will be of particular interest to the fleet, transportation and/or operations managers of wholesale distribution companies; first:
Today (January 3, 2011), new federal regulations go into effect prohibiting the use of hand-held cell phones by drivers of commercial motor vehicles (CMV) in interstate commerce. According to Transportation Secretary Ray LaHood, “Drivers who violate the restriction will face federal civil penalties of up to $2,750 for each offense and disqualification from operating a commercial motor vehicle for multiple offenses.” Further, employers “that allow their drivers to use hand-held cell phones while driving will face a maximum penalty of $11,000.” To view this new rule promulgated by the Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) and Pipeline and Hazardous Materials Safety Administration (PHMSA), go to: http://www.fmcsa.dot.gov/rules-regulations/administration/rulemakings/final/Mobile_phone_NFRM.pdf

As you know, the new regulation follows the promulgation in September 2010 by FMCSA and last February by PHMSA of regulations banning texting by drivers operating CMVs. To view the texting ban rule which went into effect on October 27, 2010, go to: http://edocket.access.gpo.gov/2010/2010-23861.htm
Second, on July 1, 2013, changes to the federal Hours of Service regulations will go into effect. (The Hours of Service regulation’s new definition of “on-duty time” will go into effect somewhat earlier – on February 27, 2012.) In addition to the on-duty time definition, the new Hours of Service regulations affect rest breaks and the 34-hour re-start period. Barry Cottrell Joins Baker Sales, Inc.
Barry L. Cottrell, a highly recognized sales and marketing manager, joins Baker Sales, Inc. as General Manager. Baker Sales, Inc. has been operating in southeast Louisiana for more than 32 years and is the area's leading distributor of steel pipe and fencing materials. Cottrell is a welcome addition to Baker's Domestic and International Sales expansion program. Cottrell will also focus on broadening product lines and improving the quality of service for their customers.
Cottrell holds a Business Management degree from the University of Northwood in Midland, Michigan. In addition to his extensive management and sales experience, Cottrell has years of military training as a Naval Officer. He and his wife, Kimberly, have 5 children. Cottrell was born in Virginia, but has spent most of his adult life in Louisiana.

Merfish Pipe & Supply Hires New General Manager / VP
Rochelle Merfish Jacobson and Gerald Merfish of Merfish Pipe & Supply are pleased to announce the addition of Robert Setzekorn as General Manager / Vice President, to their 90-year family owned operation. Robert comes to Merfish having spent 28 years in the building materials industry.
Merfish's large warehouse and office facility, located between the Port of Houston and downtown Houston houses the largest quantity of merchant pipe inventory in the USA. At Merfish, Robert will provide leadership for several key functional areas of the company, reporting to the Owners.

Paul Oscar Joins Kelly Pipe
Paul Oscar, a highly respected mid-west pipe sales executive has joined Kelly as manager of their key Chicago Branch. Paul brings 25 years of valued experience to this important role having been previously with Tubular Steel, A.M. Castle, Plymouth Tube, and Marmon/Keystone. He intends to continue Kelly's singular focus on master distribution while at the same time broadening the product line in his territory. Kelly's plans call for expanding their facilities in the Chicago area under Paul's management.

Doug Chapman Joins Kelly Pipe
Doug Chapman, a prominent PVF manager with over 30 years experience in the industry has joined Kelly Pipe as Manager of the Company's Southeast Region. Doug comes to Kelly from Macsteel Service Centers USA where he was VP Pipe Products for Eastern North America, responsible for marketing and distribution from the Mississippi to the Atlantic. With Kelly, Doug will continue to focus on sales of seamless and welded pipe to the energy, industrial and plumbing industry sectors in the Southeast. The Company intends to establish a major distribution center in Charlotte, North Carolina along with a coastal shipping center to expand its service in this region of the country.
Doug and his wife Julie live in Charlotte. They have three grown children, including one son in high school, and six grandchildren.
Kelly CEO, Len Gross, indicates this expansion enables Kelly to further enlarge its prominence in key business regions throughout the US as well as overseas. Len stated that additional regional penetration is expected as the Company maintains its leadership in carbon steel pipe distribution.

Kelly Pipe has appointed Pete Pieterse Sales Manager for its headquarters branch in Santa Fe Springs, CA. Pete has 33 years extensive experience in carbon steel pipe sourcing and sales, the last 14 years as Western Regional VP for Mac Steel. Prior to that he was Purchasing Product Manager for State Pipe. Pete has significant know-how as a master distributor of A grade pipe products, which will compliment Kelly's broad product mix throughout its widespread branch network.
