A note from the NASPD President, Bill Buckland:
On December 31, a group of US drill pipe producers filed antidumping and countervailing duty petitions on drill pipe imported from China.
The petition was filed by the law offices of Roger Schagrin on behalf of:
- TMK IPSCO
- VAM Drilling USA
- Texas Steel Conversions
- Rotary Drilling Tools
- United Steel Workers Union
US Steel and Grant Prideco are not petitioners.
A copy of the Schagrin petition, the ITC notice of investigation (issues December 31) and the schedule for antidumping and countervailing duty investigations before the ITC and the Commerce Department can be found below:
Other important facts:
- This is the first trade case filed against drill pipe from any country.
- In December, the U.S. International Trade Commission found "injury" on imported OCTG (casing and tubing).
- The International Trade Commission has a preliminary injury hearing on January 20, 2010. The preliminary injury determination is being scheduled.
- The loss of import competition will likely send prices of all these products significantly higher.
- The drill pipe schedule (see attached Excel file) for the investigation shows that the preliminary subsidy determination will issue on March 26. Imports currently entering the US ports could be subject to countervailing duties on a retroactive basis ("critical circumstances"). This is a possibility, not a certainty.
- Oil and gas producers and the distributors that supply them will be affected by these cases.
- Additional cases involving other import sources cannot be ruled out.
- The nature of the antidumping and countervailing duty laws is unusual in the United States ("retrospective" system), making the consequences of these cases potentially more severe than in other markets.
